TERMS OF SERVICE
WebAttention provides World Wide Web page hosting. WebAttention reserves the right to suspend or cancel a customer's access to any or all services provided by WebAttention when WebAttention decides that the account has been inappropriately used or otherwise.

SERVER USE
Personal accounts are to be used by the primary owner only. Personal account holders are not permitted to resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.

Customers may however resell our Reseller packages.

WebAttention reserves the right to refuse service and /or access to its servers to anyone.

WebAttention do not allow any of the following content to be stored on its servers:
Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.

Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of WebAttention.

Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

SPAM (U.C.E.) POLICY
Sending unsolicited commercial bulk email ("UCE"), news postings or chain letters; advertising transmitting, or otherwise making available any software, program, product, or service that is designed to facilitate sending UCE; use of web pages that allow "spam"ing (known as "ghost sites") that directly or indirectly refers to domains or IP addresses hosted by WebAttention.  Maintaining an Open Email Relay allowing email to be sent through a customer's system by a third party (i.e. neither to nor from Customer or Customer's accounts). WebAttention reserves the right to determine in its sole discretion what constitutes UCE based on the information available.  

HIGH RESOURCE USER POLICY
Resources are defined as bandwidth and/or processor utilization.

WebAttention may implement the following policy to its sole discretion:

When a website is found to be monopolizing the resources available WebAttention reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby WebAttention continues hosting the website for an additional fee. 

PAYMENT POLICIES
All accounts are set up on a prepay basis. Although WebAttention reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established. Customers will automatically be charged again at the end of their prepay period unless closure notification has already been given.

In situations where the card number on file is declined WebAttention will immediately suspend the facility to purchase services on-line until the outstanding charge is processed successfully. In addition, WebAttention reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request.

No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via email shortly after the online purchase has been made. At this point the customer's card will be charged automatically.

WebAttention bills only in UK Sterling.  Although options are available to purchase services in different currencies, you will be billed in GBP.  Because of this, prices may vary slightly according to up-to-date currency rates dictated by our Credit Card Processor.   This will only happen if you choose a currency other than GBP to pay in.

PAYMENT OPTIONS
In order to streamline our accounting procedures and keep costs down WebAttention runs a limited number of payment options.

Credit / Debit Cards:
WebAttention accepts Mastercard, Visa (not Visa electron), Switch and Solo

Cheque Payment:
This option is only available to customers who pay annually for their WebAttention account. A credit/debit card number will still be required if customers require the facility to purchase domains and other services on-line. WebAttention cannot guarantee that a service will be provided until after any received cheques have been cleared.

30 DAY TRIAL
For customers opening their first account the initial 30 days are available on a trial basis. For special promotions offered at discounted prices the trial period is limited to the initial 7 days. Customers will not be entitled to this benefit if they have previously had an account with WebAttention unless the period of absence has been greater than one year. New customers will not be entitled to a trial period if any account has previously been created at the same postal address within the same 12 month time span.

CANCELLATION AND REFUNDS
WebAttention reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of membership. If a customer contravenes WebAttention' terms of service a refund will not be issued in the event of a cancellation.

Customers may cancel their account at any time. During the initial trial period customers who wish to cancel will be entitled to a full refund for their hosting fees. Any incentives offered to customers when opening the account will also be cancelled. Customers may be given the option to purchase services which were offered as start-up incentives in the result of a cancellation.

Once the initial trial period has expired customers are not entitled to receive a refund unless the service is cancelled by WebAttention. In addition some accounts incur set-up fees, these charges are also non-refundable.

Note: Cancellation of dedicated servers may require up to 31 days' notice depending upon the policies of our supplier. Please contact us in advance to be advised of your specific cancellation date.

INDEMNIFICATION
Customer agrees that it shall defend, indemnify, save and hold WebAttention harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against WebAttention, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless WebAttention against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with a WebAttention server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from a WebAttention server.

DISCLAIMER
WebAttention will not be responsible for any damages your business may suffer. WebAttention makes no warranties of any kind, expressed or implied for services we provide. WebAttention disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by WebAttention and its employees. WebAttention reserves the right to revise its policies at any time.

Acceptable Use Policy


During the term of its agreement with webattention.net, Customer must ensure that the use of any resource offered to Customer or owned or controlled by webattention.net ("Service") conforms with webattention.net's then current Acceptable Use Policy ("AUP"). webattention.net may modify, without prior notice, the AUP as webattention.net deems appropriate; such modified AUP is effective upon posting on webattention.net's website.

Inappropriate Use

The Service must not be used to publish, post, distribute or otherwise disseminate unlawful material or information including, but not limited to: threatening, harassing, defamatory, obscene, or fraudulent information and materials, or proprietary, copyrighted, or otherwise intellectually protected information and materials for which Customer does not have authorization or authority to possess or distribute. The Service must not be used to request unlawful services or materials. The Service must not be used for activities webattention.net deems to impact its customers or its ability to deliver services to its customers. Such activities may include, but are not limited to:

Obscene Speech or Materials
The distribution of child pornography or any obscene, abusive, defamatory or threatening speech or material.

Intellectual Property Infringement
Any activity infringing on the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, and patents.

Spamming
Sending unsolicited commercial bulk email ("UCE"), news postings or chain letters; advertising transmitting, or otherwise making available any software, program, product, or service that is designed to facilitate sending UCE; use of web pages that allow "spam"ing (known as "ghost sites") that directly or indirectly refers to domains or IP addresses hosted by webattention.net. webattention.net reserves the right to determine in its sole discretion what constitutes UCE based on the information available.

Maintaining an Open Email Relay
Allowing email to be sent through Customer's system by a third party (i.e. neither to nor from Customer or Customer's accounts).

Fraud
Using a false identity; using pyramid/ponzi scheme; storage or transmission of any intentionally incorrect data or packet.

Virus, Worm, or Trojan horse program distribution
The deliberate transmission of computer viruses, worms or trojan software.

Denial of Service
Using any technique to intentionally degrade or disable the delivery of any legitimate data.

Unauthorized Access
Attempting to gain unauthorized entry to any site or network, or any network or host scanning, probing, monitoring or other information gathering associated with such activity; using the Service to guess passwords.

Public Forums
Inappropriate postings to newsgroups, chat rooms, electronic bulletin boards and any other public forum on, or using, the Service.

Customer Responsibilities

Bulk Email
Customers sending bulk email must provide recipients with an easy and effective mechanism for removal from bulk email list. Customer must include the source of the addressee's address in each bulk email message.

Service Resale
Customer agrees not to resell the Service or any portion of the Service unless expressly authorized to do so by webattention.net.

Password Protection
Customer is responsible for protecting passwords and for any authorized or unauthorized use.

Content Protection
Customer agrees to provide appropriate protection to prevent minors (persons under 18 years of age) from accessing any unsuitable material that Customer publishes via any Service.

Content Ownership
Customer is responsible for all content or information residing on, or obtained or transmitted via, the Service, regardless of whether such use is by Customer.

Facilitating AUP Violation
Customer activity that facilitates the violation of this AUP by any party constitutes a violation of this AUP by Customer.

AUP Enforcement

Violation of the AUP may subject Customer to international, federal, and/or state civil and/or criminal liability. webattention.net reserves the right in its sole discretion and without prior notice to suspend and/or terminate Customer's access to the Service at any time for violating this AUP. webattention.net also reserves the right to suspend, filter or block, and/or terminate Customer's access if Customer's account is being used to exploit or attack the Service or the networks of others. If Customer's account has been compromised and attempts to reach Customer and/or to have Customer repair a breach of security fail, webattention.net reserves the right to suspend or terminate Customer's service. If Customer's access is suspended or terminated, webattention.net, in its sole discretion, may refuse to accept all new e-mail sent to the terminated e-mail address and delete Customer's data stored on Service. webattention.net will fully cooperate with law enforcement authorities in the detection and prosecution of illegal activity.

Webattention.net is committed to safeguarding your privacy online. Please read the following statement to understand how your personal information will be treated as you make full use of our web site.

Gathering of Information

Voluntary Submission
Webattention.net does not collect personally identifying information about any individual web site user except when knowingly provided by such individual. For example, we may ask you for information when you register for a contest or survey or to receive a newsletter. You always have the option not to provide the information we request. If you choose not to provide the information we request, you can still visit most of the Webattention.net Web site, but you may be unable to access certain options and services.

Cookies
A cookie is a data file that certain Web sites write to your computer's hard drive when you visit such sites. A cookie file can contain information, such as a user identification code, that the site uses to track the pages you have visited. Webattention.net uses cookies solely to track user traffic patterns throughout the web site. We use this data on an anonymous basis and we do not correlate this information with personal data of any user.

Most Web site browsers automatically accept cookies, but you can usually change your browser settings to display a warning before accepting a cookie, or to refuse all cookies. However, if you choose to disable the receipt of cookies from our Web site, you may not be able to use certain features of the site.

Browser Level Information
Webattention.net Web servers automatically collect information about a site user's IP address, browser type and referrer by reading this information from the user's browser (information provided by every user's browser). This information is collected in a database and used--in an aggregated, anonymous manner--in our internal analysis of traffic patterns within our Web site. This information is automatically logged by most Web sites.

Use of Information
Our primary goal in collecting user information is to enhance your experience on our Web site.  To develop content targeted to your interests, we use aggregated user information to determine which areas of our Web site users prefer based upon traffic to those areas. We do not track what individual users read, but instead how well each page or content area performs overall.

We do not disclose personally identifying information about our users to third parties.

Webattention.net may disclose information about our users when we believe, in good faith, that the disclosure is required by law.

When you are on an area of Webattention.net and are asked for personal information, you are sharing that information with Webattention.net, and only Webattention.net.  If you do not want your information to be shared, you can choose not to allow the transfer of your information by not using that particular service.

Webattention.net users should be aware that, when you voluntarily disclose personal information in chat areas or bulletin boards, that information may be collected by others and may result in unsolicited messages from others.

Service Level Agreement


An important part of choosing your hosting provider is the level of service that you receive from your chosen company.

The lowest price is not always the best if it means sacrificing speed of bandwidth and support staff who know what they are talking about.

At WebAttention.net we pride ourselves on the highest levels of quality and customer service, to give our customers peace of mind we have a guaranteed Service Level Agreement (SLA).

The two major points of our Service Level Agreement are:-

99.5% Connectivity and Network Uptime

We guarantee that our connectivity will be available at least 99.5% of the time (even though we are normally available 100% of the time). 

The WebAttention.net availability guarantee ensures Internet connectivity is provided to our customers 99.5% of the time and, as set forth below; WebAttention.net will credit Customer's account if we fail to meet this Network Uptime Guarantee during any given calendar month. At Customer's request, WebAttention.net will calculate Customer's "Network Unavailability" in a calendar month. "Network Unavailability" consists of the number of minutes that the WebAttention.net Network was not available to the customer, but will not include unavailability which Customer fails to report to WebAttention.net within seven days, or any unavailability resulting from 

Should we fail this promise and our network is unavailable for more than 99.5% in any full calendar month then we will refund one (1) day of service for every hour connectivity has been unavailable over and above 99.5% of that month. This guarantee extends in value up to a maximum of your monthly subscription charge. 

Bandwidth Guarantee

Many providers oversell their bandwidth, this means that if all their customers started to use more bandwidth then they would not have the capacity to handle this and as a result your servers would be very difficult and slow to access.

At WebAttention.net we guarantee that we have a 1:1 contention ratio on bandwidth. This means that we will always have enough bandwidth to service every single customer at their full capacity.
